Policy 543 - Unsafe Behavior of Students
PURPOSE
A positive and stimulating learning environment is critical to student success. The culture of the Minnetonka School District will demonstrate support and caring for all members of our community. The purpose of this policy is to ensure to the greatest extent possible, that all students in the Minnetonka Public Schools shall be provided with safe and secure schools and a safe and orderly environment conducive to learning.
GENERAL STATEMENT OF POLICY
Reporting Unsafe Acts
Each District employee who knows or has reason to believe that an “unsafe act” has been committed or will be committed at a school, on District property, or at a District-sponsored activity shall immediately report that “unsafe act” to a District administrator who will report the act to an appropriate state or local law enforcement agency.
For purposes of this policy, an “unsafe act” includes, but is not limited to, any act that involves or will involve a direct or immediate threat to the safety or security of human life; the possession, use, or dispensing of tobacco, drugs, alcohol, explosives, firearms, or other weapons; or the commission of an inherently dangerous criminal act, including murder, kidnapping, robbery, felony theft, burglary, arson, aggravated assault, aggravated battery, any felony drug offense, and any sexual crime.
Distributing the Names of Students Engaged in Unsafe Acts
District employees shall report to the Superintendent, or designee, the identity of any student who meets any of these criteria:
- Conduct that endangers the safety of others;
- Conduct that constitutes the commission of a felony (if an adult) or would constitute the commission of a felony (if committed by an adult);
- Possession of a weapon;
- Adjudged to be a juvenile offender and whose offense, if committed by an adult, would constitute a felony under the laws of Minnesota or the state where the offense was committed, except a felony theft offense involving no direct threat to human life; or
- Tried and convicted as an adult of any felony, except felony theft involving no direct threat to human life.
Video Surveillance Cameras
The District may use video surveillance cameras to monitor the activity of any individual in District facilities or on District property. Video cameras may also be used to monitor students riding in District-owned or District-contracted vehicles.
Videotapes that are records of an individual’s behavior shall be secured in a locked file until the tapes are either reused or erased. Videotapes shall be subject to current law concerning the release of personnel or student record information.
